Cases Against Cancer-Causing Weed Killer RoundUp Continue To Grow

Stockholders of the 150-year old pharmaceutical company, Bayer AG (makers of Bayer Aspirin), were shocked when the company was hit with a $289 million jury verdict involving the weed killer RoundUp, only 2 months after Bayer had acquired the Monsanto Corporation – makers of RoundUp – in a $66 billion merger. That shock quickly turned to anger against corporate executives with accusations that they had failed to realize and/or failed to inform shareholders of the huge potential liability risk that the Monsanto merger carried with it (70% of Monsanto’s profits come from the sale of RoundUp products). Since that verdict (which was subsequently reduced to $78.5 million by the judge), Bayer stock has fallen some 30% or so, losing over $20 billion in value. At the time of the verdict, there were 5,000+ cases pending against Bayer/Monsanto for cancers caused by RoundUp and since the verdict, that number is now approaching 10,000 cases.

The Dwayne Lee Johnson Case

For several years now, there have been scientifically-backed allegations that exposure to glyphosate – the active ingredient in RoundUp causes certain cancers, including Non-Hodgkin Lymphoma. It has been labeled as a cancer-causing agent by the World Health Organization and its use has been banned in a number of cities and states in the U.S. In 2014, a California high school groundskeeper, Dwayne Lee Johnson, who had regularly used RoundUp at work, was diagnosed with Non-Hodgkin Lymphoma at age 42. His condition is terminal. The $289 million jury verdict was the result of the lawsuit he filed against Monsanto claiming that they knew of the dangers associated with use of RoundUp and failed to properly warn him.

Smoking Guns At Trial

During the trial of Mr. Johnson’s case, Monsanto successfully fought to keep the jury from knowing that glyphosate had been banned in Europe and that California had forced manufacturers of glyphosate-containing products, including RoundUp to place warning labels on their products. The “smoking gun” that really incensed the jury and led to the huge verdict however, was when they found out that many of the “independent scientific studies” relied upon by Monsanto to prove the safety of RoundUp were in actuality secretly written, reviewed, edited and paid for by Monsanto prior to publication!

Upcoming Cases

There are a number of RoundUp cases set for trial in early 2019. Among these is the case of the California husband and wife, Alva and Alberta Pilliod, who both regularly used RoundUp for over 35 years and who both have developed Non-Hodgkin Lymphoma. Bayer/Monsanto continues to maintain that RoundUp is safe to use and poses no health risks (not unlike the tobacco companies who for years claimed that smoking was harmless). Bayer/Monsanto has also indicated that it intends to fight and contest all RoundUp cases and have no interest in settling any of them. It will be interesting to see how long the Bayer stockholders will tolerate this attitude if additional large verdicts are rendered and if the stock continues to tank.
