Nursing home abuse in Alabama – 3 former employees plead guilty

Ten months after their original indictment, three former nursing home employees have plead guilty to attempted elder abuse and of nursing home neglect in Centre, Alabama.

According to Attorney General Steve Marshall’s announcement, the three former employees worked for Cherokee Health and Rehab, a nursing home in Cherokee County. Sandra Michele Curry, 42, is a licensed practical nurse; Kacey Minerva Allen, 28, and Shawna Rogers, 26, instead, are certified nursing assistants. Rogers lives in Rome, Ga; Allen and Curry live in Centre. They were indicted on February 2017.

The trio was responsible for the care of an 84-year-old resident of the facility. The woman was confined to a bed throughout the night of Sept. 3, 2016 and into the following morning. According to the investigation, the next morning woman was found to be suffering from over 100 ant bites. Rogers, Curry and Allen originally claimed that they checked on the resident numerous times throughout the night, but a later review of the surveillance video found that none of them ever entered the room where the patient was totally unattended for almost 11 hours.

Their intentional neglect might have directly contributed to the injuries suffered by the resident. Attorney Marshall stated that Alabama law recognizes the legal responsibilities of those entrusted with taking care of the most vulnerable populations of the state, such as the elderly and the disabled. According to his opinion, the defendants lied about their negligence, failed to provide proper care, and should be held liable of the injury and harm suffered by the patient.

Eventually, the three pleaded guilty of attempted elder abuse and neglect in Cherokee County Circuit Court. Since this is a class C felony, the women were sentenced to 2 years in prison, but they have been placed on probation. However, Curry had her nursing license revoked and all three are permanently banned from working in any healthcare facilities.
